As part of the County’s “Community Beautification Campaign,” the County plans to adopt two
new Chapters to the County Ordinance, one (Chapter 12.09) addressing the problem of stolen
shopping carts which have been abandoned in the County’s unincorporated area and the
second (Chapter 12.10) addressing the unregulated proliferation of newsracks in and about
the public right of way.
These new Ordinance provisions will supplement existing State and County laws addressing
related issues. The following are some examples of those existing laws along with the 2 new
provisions:
Penal Code Section 374.2: prohibits dumping of hazardous or harmful substances
damaging sewer sanitary facilities;
Penal Code Section 374.3: prohibits dumping of waste matter, dirt or rocks on public or
private roads and rights of way;
Penal Code Section 374.4: prohibits littering on public and private property;
County Ordinance Section 6.44: anti-litter provisions prohibiting, for example, litter,
dirt, grass, weeds and other rank growths injurious to health, safety and welfare;
County Ordinance Section 6.48: the anti-“junk vehicles” provisions prohibiting, for
example, the accumulation and/or storage of wrecked, dismantled, abandoned or
inoperative vehicles, trailers, boats or other mobile equipment;
County Ordinance Section 6.64: generally prohibits various types of nuisances such
as, for example, the storage of abandoned, discarded or dilapidated objects or other
objects threatening the health or safety of any person or contributing to blight or
property degradation or the accumulation of litter, rubbish and debris;
County Ordinance Chapter 12.09: regulates the placement and use of newsracks in
the public right of way requiring necessary maintenance and other controls to promote
the public health, safety and welfare;
County Ordinance Chapter 12.10: requires business owners to provide an effective
plan to reduce and eliminate abandoned shopping carts in the County’s unincorporated
area.
